1. Acceptance of these terms
These Terms & Conditions (“Terms”) are an agreement between you and the operator of QKeyboard (“QKeyboard,” “we,” “us,” or “our”). They apply to the QKeyboard iOS application, custom keyboard extension, websites, AI features, and related services (collectively, the “Service”).
Apple is not a party to these Terms and is not responsible for the Service, except as required by the App Store terms that apply to you and QKeyboard.
2. Eligibility
You must be legally capable of entering into these Terms. If you have not reached the age of legal majority where you live, you may use the Service only with permission and supervision from a parent or legal guardian. You may not use the Service if applicable law prohibits you from doing so.
3. What QKeyboard provides
QKeyboard is an AI-assisted writing tool. It can send text you choose to an AI service and present a generated rewrite based on a selected writing mode or instruction. Features may include grammar correction, tone changes, shortening, expansion, translation, custom modes, copying, and replacement of text in compatible apps.
The Service assists with writing; it does not guarantee that text is correct, appropriate, original, complete, or suitable for any particular purpose.
4. Keyboard and Full Access
The iOS keyboard extension requires “Allow Full Access” to communicate with an AI provider over the internet. When you initiate an AI action, QKeyboard may use selected text or available text from the active input field to perform that request.
You are responsible for choosing where to enable and use QKeyboard. Do not submit confidential, regulated, proprietary, or personal information unless you have the right to do so and accept the processing practices of the selected AI provider.
iOS, secure fields, and host apps may restrict keyboard access, text context, replacement, or network behavior. QKeyboard does not guarantee compatibility with every app or input field.
5. AI-generated output
You are solely responsible for evaluating, editing, and deciding whether to use generated output. QKeyboard is not a substitute for professional legal, medical, financial, academic, safety, or other expert advice. Do not rely on output where an error could cause harm or violate a duty you owe to another person.
Generated output may resemble content produced for other users and may not qualify for intellectual-property protection. QKeyboard does not promise that output is unique or free from third-party rights.
6. Your content
You retain any rights you have in text and instructions you submit (“User Content”). You grant QKeyboard a limited, non-exclusive right to process and transmit User Content only as reasonably necessary to provide, secure, troubleshoot, and improve the requested Service, comply with law, and enforce these Terms.
You represent that you have all permissions needed to submit User Content and that its submission and requested processing do not violate law, confidentiality obligations, privacy rights, intellectual-property rights, or other rights.
How an external AI provider uses User Content is governed by that provider’s terms and your configuration with it.
7. Bring Your Own Key
If you use an API key or endpoint you provide, you are responsible for:
- having authority to use the account, key, model, and endpoint;
- all provider charges, quotas, restrictions, and account activity;
- reviewing and complying with the provider’s terms, privacy policy, and acceptable-use rules;
- the security, rotation, revocation, and accuracy of your credentials and configuration; and
- ensuring the endpoint is trustworthy and uses appropriate transport security.
QKeyboard is not responsible for the acts, omissions, outages, billing, output, data practices, or security of a provider you configure.
8. QKeyboard AI
QKeyboard may offer an included or managed AI option. Its availability, supported models, capacity, request limits, and providers may change. Access can be restricted or suspended to protect the Service, respond to abuse, comply with provider requirements, or meet legal obligations. No specific model or provider is guaranteed.
9. Acceptable use
You must not use the Service to:
- break the law, violate another person’s rights, or evade lawful safeguards;
- create or distribute malware, phishing, fraud, spam, harassment, exploitation, or instructions intended to cause harm;
- submit content you are not authorized to disclose or process;
- probe, attack, disrupt, overload, reverse engineer, or bypass security, quotas, access controls, or subscription checks, except where law expressly permits;
- misrepresent AI-generated content in a deceptive or unlawful way; or
- use the Service in a high-risk system where failure could lead to death, serious injury, or significant physical or environmental damage.
10. Subscriptions, renewal, and billing
QKeyboard may offer a monthly auto-renewable subscription, including QKeyboard Pro. The price and subscription period are displayed in the App Store purchase screen before you confirm payment.
- Payment is charged to your Apple ID account after purchase confirmation.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current billing period, subject to Apple’s applicable rules.
- Apple may charge your account for renewal within 24 hours before the current period ends.
- You can manage or cancel the subscription in your Apple ID subscription settings.
- Deleting QKeyboard does not automatically cancel a subscription.
- Restore Purchases can be used to restore eligible entitlements associated with your Apple ID.
Apple processes payments and handles billing disputes and refunds under its policies and applicable law. QKeyboard does not receive your complete payment-card details. Any trial, promotion, or introductory offer is governed by the terms shown when offered.
11. Free access and usage limits
Free access may be subject to daily or other limits. Current limits can differ between QKeyboard AI and Bring Your Own Key. A paid plan may remove or increase certain app-enforced limits, but it does not remove limits, costs, or restrictions imposed by a third-party AI provider.
Limits, included features, and plan benefits may change for operational, economic, security, or product reasons. Material changes to an active paid subscription will be handled in accordance with applicable law and App Store requirements.
12. QKeyboard intellectual property
The Service, including its software, interface, branding, designs, documentation, and non-user content, is owned by QKeyboard or its licensors and is protected by applicable intellectual-property laws. Subject to these Terms, you receive a limited, personal, revocable, non-exclusive, non-transferable license to use the Service on Apple-branded devices you own or control as permitted by the App Store usage rules.
These Terms do not grant you any right to QKeyboard trademarks, source code, or other proprietary materials except for the limited right to use the Service.
13. Apple and third-party services
The Service depends on iOS, the App Store, network services, and AI or infrastructure providers. Their own terms and privacy policies apply. QKeyboard is not responsible for third-party services and does not guarantee their continued availability or compatibility.
Apple has no obligation to provide maintenance or support for QKeyboard. To the extent a warranty is required and cannot be disclaimed, Apple may refund the purchase price, if any, as provided by Apple’s applicable terms; Apple has no other warranty obligation for the Service. Apple and its subsidiaries are intended third-party beneficiaries of these Terms and may enforce the Apple-related provisions against you.
14. Availability, updates, and changes
The Service may be modified, updated, interrupted, or discontinued. QKeyboard may add or remove features, models, providers, modes, limits, or device requirements. Maintenance, network failures, provider outages, Apple platform changes, security incidents, or other events may make the Service unavailable.
You are responsible for maintaining compatible software, internet access, and any provider account required by your configuration. Support may be provided through the contact channel below but no response time is guaranteed.
15. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, non-infringement, availability, or security.
QKeyboard does not warrant that the Service or AI output will be uninterrupted, error-free, accurate, safe, unique, or compatible with every app, provider, language, or device. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
16. Limitation of liability
To the maximum extent permitted by law, QKeyboard and its operator, affiliates, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or use, arising from or related to the Service, AI output, provider behavior, or these Terms.
To the maximum extent permitted by law, QKeyboard’s total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid for QKeyboard during the 12 months before the event giving rise to the claim or (b) US$50. These limits apply regardless of the legal theory and even if a remedy fails its essential purpose.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or rights you have under mandatory consumer-protection law.
17. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless QKeyboard and its operator, affiliates, suppliers, and licensors from claims, damages, losses, liabilities, and reasonable costs arising from your User Content, your misuse of the Service, your violation of these Terms, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from QKeyboard’s own unlawful conduct.
18. Suspension and termination
You may stop using QKeyboard at any time. QKeyboard may suspend or terminate access to online features if you materially violate these Terms, create risk or harm, fail to pay applicable charges, abuse the Service, or if suspension is reasonably necessary for security, provider compliance, or legal reasons.
Termination does not automatically cancel an App Store subscription; you must cancel it through Apple. Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limits, indemnity, and general legal terms—will survive.
19. General terms
Changes to these Terms
These Terms may be updated as the Service or legal requirements change. The updated version will show a new “Last updated” date. Material changes will receive reasonable notice where required. Continuing to use the Service after the effective date means you accept the revised Terms.
Governing law
These Terms are governed by the laws applicable in the jurisdiction where the QKeyboard operator is established, without regard to conflict-of-law rules, except that mandatory consumer laws in your place of residence continue to apply. Courts with lawful jurisdiction may hear disputes that cannot be resolved informally.
Entire agreement and severability
These Terms and the Privacy Policy are the entire agreement concerning the Service unless additional written terms apply to a specific feature. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect.
No waiver or assignment
A failure to enforce a provision is not a waiver. You may not assign these Terms without QKeyboard’s consent. QKeyboard may assign them as part of a reorganization, financing, merger, sale, or transfer of the Service, subject to applicable law.
